Terms of Service

1. Acceptance of Terms

By accessing or using FootyIQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may modify these terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

FootyIQ is a football quiz web application offering multiple game modes, an XP/leveling system, daily streaks, and leaderboards. The Service is available in both a free tier and a premium subscription tier ("Ball Knowledge").

3. Account Registration

• You must provide a valid email address and choose a display name to create an account.
• You are responsible for maintaining the security of your account credentials.
• Display names must not be offensive, impersonate others, or violate any third-party rights.
• You must be at least 16 years old to create an account.
• We reserve the right to suspend or delete accounts that violate these terms.

4. Premium Subscription

• The "Ball Knowledge" premium subscription is billed monthly via Stripe.
• Subscriptions auto-renew unless cancelled before the end of the billing period.
• You can manage or cancel your subscription at any time through the Stripe Customer Portal (accessible from your profile page).
• Refunds are handled in accordance with applicable consumer protection laws. Contact us for refund requests.
• We reserve the right to change subscription pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to exploit, hack, or reverse-engineer the Service.
• Use automated tools (bots, scrapers) to interact with the Service.
• Interfere with other users' enjoyment of the Service.
• Create multiple accounts to circumvent free-tier limits or bans.
• Submit offensive, misleading, or inappropriate display names.

6. Intellectual Property

The FootyIQ brand, logo, game mechanics, and original content are the intellectual property of the operator.

Player data, club logos, and related football imagery are sourced from third-party providers and remain the property of their respective owners (see disclaimer in the footer). FootyIQ does not claim ownership of third-party content.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. Game data (player statistics, transfer histories, market values) is provided for entertainment purposes and may contain inaccuracies.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FootyIQ and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

9. Account Termination

• You may delete your account at any time from your profile page.
• We may suspend or terminate your account for violations of these terms, with or without notice.
• Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

10. Governing Law & Dispute Resolution

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the jurisdiction of the courts in Germany. For EU consumers, mandatory consumer protection laws of your country of residence apply in addition.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users via email or in-app notification at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
